Summary:
This seminar is designed for attorneys who do not usually practice in this subject matter area. It will provide a background in current bankruptcy law and procedure, covering the basics of bankruptcy law and practice of Chapter 7 and Chapter 13, the first meeting of creditors, and 11 U.S.C. § 341, the professional responsibility of the attorneys in Chapter 7, and corporation in Chapter 7 and Chapter 11. Ethical considerations will also be discussed.

The Honorable Robert J. Faris, Chief Judge of the United States Bankruptcy Court for the District of Hawaii; Judge of the United States Bankruptcy Appellate Panel of the Ninth Circuit
Robert J. Faris is the Chief Judge of the United States Bankruptcy Court for the District of Hawaii. He is also a judge of the United States Bankruptcy Appellate Panel of the Ninth Circuit. He received a B.A. from Reed College in 1980 and was elected to Phi Beta Kappa.. He received his J.D. from the Boalt Hall School of Law, University of California, Berkeley, in 1983. He served as an associate editor of the California Law Review in 1982-83, published “Insurance Corporation of Ireland v. Compagnie des Bauxites de Guinee: Justifying Establishment of Jurisdiction as a Discovery Sanction,” 70 Calif. L. Rev. 1446 (1982), and was elected to the Order of the Coif. From 1983 until 2002, he practiced with a Honolulu law firm, emphasizing bankruptcy, insolvency, and commercial litigation. He became a bankruptcy judge in February 2002 and joined the Bankruptcy Appellate Panel in August 2015. He is a member of the American Bankruptcy Institute, the National Conference of Bankruptcy Judges, and the American College of Bankruptcy.

Jerrold K. Guben, Partner at O’Connor Playdon Guben & Inouye LLP
Jerrold K. Guben is a partner at O’Connor Playdon Guben & Inouye LLP. He concentrates his practice in commercial and corporate litigation, bankruptcy and corporate reorganizations. He received his B.S. degree from the University of Southern California, his A.M. degree from the University of Michigan and his LL.B. degree from Harvard Law School. Mr. Guben has served as a lecturer in law and as a research associate at Yale Law School, and was on the faculty of the William S. Richardson School of Law, University of Hawaii. He is a member of the Hawaii State Bar Association and the State Bar of California.

Rick Abelmann, Bankruptcy Attorney in Hawaii and New York
Rick Abelmann is a bankruptcy attorney admitted to practice in Hawaii and New York. He graduated in economics from Brigham Young University before obtaining his law degree at Washington University in St. Louis. Rick previously practiced corporate and securities law in Hong Kong with Clifford Chance and worked on the trading floor for the institutional equities division of Morgan Stanley. Rick moved to Hawaii in 2009 and has been practicing consumer bankruptcy since then, now as a Member of Abelmann Peterson LLLC.
Aside from his law practice, Rick spends time with his wife and three children. He also enjoys surfing whenever he can find swell. Rick is a member of the Hawaii State Bar Association, the Hawaii Filipino Lawyers Association, the New York State Bar Association, and an active member of the National Association of Consumer Bankruptcy Attorneys (NACBA). He spends several weeks a year involved as a Director of the nonprofit organization he founded called Help One Future, which provides donated school supplies and books primarily to elementary level students in remote areas in the Philippines. He also volunteers his time with Volunteer Legal Services Hawai’i helping low-income people and families have access to justice. He served as a Lawyer Delegate to the USDC District Conference for 2013-2016.
