Business Interruption Insurance - Does It Cover Covid-19?

Summary:
As the stay-at-home orders and social distancing requirements of COVID-19 disrupt business in Hawaii, many businesses will turn to their commercial insurance policies, which may include business interruption insurance coverage, for financial assistance to cover payroll, rent, other liabilities, and potentially lost profits.  This has sparked litigation around the country over coverage.  Even President Trump recently weighed in on this hot topic saying he “would like to see the insurance companies pay if they need to pay.”  In this one-hour webinar, the presenters will address frequently asked questions such as:

  • What is business interruption insurance?
  • What should you look for in your policies to determine coverage?
  • What can you do to preserve and/or assert your rights under your policy?
  • Whether government action or case law provides guidance on coverage?
  • What is the impact of force majeure clauses on business interruption losses?

Speakers:
Ronald I. Heller,
Director, Torkildson Katz Hetherington Harris & Knorek. 
Ron has been practicing law in Hawaii for over 35 years, focused on resolving business disputes, including financial, tax and accounting issues.  He received both JD and MBA degrees from the University of Michigan, and is a licensed Certified Public Accountant as well as an attorney.  He also served as an Adjunct Professor at the William S. Richardson School of Law and has taught a number of continuing professional education courses for attorneys, CPAs, and others.  He served a four-year term as a Commissioner on the Land Use Commission of the State of Hawaii, including a year as Chair of the Commission. He has served on the Board of Directors of the Hawaii Society of Certified Public Accountants since 1988, and served as the Society's President for 1994-95.  His efforts have led to peer recognition including the maximum 5 out of 5 peer rating and an AV Preeminent Rating by Martindale Hubbell. He also received a perfect 10 AVVO Rating as a "Top Tax Attorney" and has been listed as one of the "Best Lawyers in America" for more than 25 years.


Brian W. Tilker,
Director, Torkildson Katz Hetherington Harris & Knorek.  
Brian concentrates his practice on business and employment litigation.  He has represented clients in matters involving breach of contract, fraud, unfair business practice claims, Medicaid, condominium association disputes, trademark infringement, mass torts, toxic torts, product liability, real estate, trusts and estates, tax controversy, ERISA, wage and hour, discrimination, harassment and retaliation litigation in state and federal courts, as well as in arbitration forums.  He serves on the Board of Directors for Guide Dogs of Hawaii and was an Adjunct Professor at the William S. Richardson School of Law for five years teaching a course in legal writing and advocacy.   Prior to joining the firm in 2011, Brian practiced law in New York City and worked in the litigation department of a major international law firm.  He strives to provide practical, creative legal advice that focuses on clients’ strategic and commercial objectives, and believes in preventing and resolving disputes in the most cost-efficient way possible.
