Summary:
Stare decisis, a Latin phrase meaning “to stand by things decided,” is a central principle in the American legal system that directs courts and judges to honor decisions from prior cases. Respect for precedent is said to give the law consistency, stability, and predictability, and to promote the integrity of the judicial process. Over the years, the U.S. Supreme Court has broken with stare decisis and overruled precedent in a number of watershed cases from Brown v. Board of Education in 1954 to Lawrence v. Texas in 2003.
More recently, in Dobbs v. Jackson Women’s Health Organization, the Court’s new conservative majority overruled Roe v. Wade and Planned Parenthood of Southern Pennsylvania v. Casey, itself an important precedent about stare decisis. In doing so, the Court laid out its current approach to deciding when a precedent should be overruled.
This seminar will explore the Court’s evolving approach to stare decisis through the lens of the Dobbs decision and other noteworthy cases affecting civil rights and liberties.

Judge Clyde J. Wadsworth, Associate Judge of the Intermediate Court of Appeals
Clyde J. Wadsworth was sworn in as an Associate Judge of the Intermediate Court of Appeals on October 21, 2019.
Prior to his judicial appointment, Judge Wadsworth served for nearly three years as Hawaii’s Solicitor General. In that capacity, he headed the Appellate Division of the Department of the Attorney General, with oversight authority over most state and federal appeals in the Department.
Judge Wadsworth has over 30 years of litigation and dispute resolution experience, representing a diversity of clients in federal and state courts, arbitration, and mediation, in a broad variety of matters. During these years, he also maintained an active pro bono practice focused on constitutional and civil rights issues. In 2006, Judge Wadsworth joined Alston Hunt Floyd & Ing, where he practiced complex commercial litigation and appeals, before entering government service in 2017.
Judge Wadsworth received his bachelor’s degree magna cum laude from Princeton University, and his law degree from the UCLA School of Law, where he served as an editor of the UCLA Law Review.
