Essentials of Elder Law including special issues in representation and advocacy for vulnerable older persons.

“Essentials of Elder Law” is meant to provide basic knowledge of the ever-expanding area of elder law, including special issues in representation and advocacy for vulnerable older persons. This seminar is designed for those attorneys interested in entering into the practice of elder law or for those who are just interested in knowing more about elder law issues that they can use in their practices or in their own family situations. Elder law is the still evolving field of law that addresses issues the rapidly growing older population faces.  Rather than being defined by technical legal distinctions, elder law is defined by the client to be served. In elder law, emphasis is placed on planning for the likelihood of an extended lifetime, including planning for the time when finances, health, mental capacity, and support structures may change, either rapidly or progressively. Vulnerable older persons are more likely to suffer from abuse, neglect (including self-neglect), and financial exploitation than other segments of the population. and understanding issues relating to mental capacity, autonomy and the ethics of the elder law practice is fundamental to this area of the law. 

Speaker:

Professor James Pietsch, William S. Richardson School of Law

James H. Pietsch joined the William S. Richardson School of Law after first having served on active duty in the US Army Medical Service Corps and the Judge Advocate General’s Corps and subsequently serving as the directing attorney of the Honolulu Elder Law Unit of the Legal Aid Society of Hawai'i (LASH). At the law school, he teaches Law, Aging and Medicine, Elder Law Clinic, Advanced Health Law (Experiential), and, in association with the Nancy Atmospera -Walch School of Nursing, Health Law: Bioethics. He also holds an appointment at the John A. Burns School of Medicine where he specializes in teaching issues at the intersection of law, aging, healthcare, bioethics, and psychiatry. In addition to his teaching duties, he is the director of the University of Hawai'i Elder Law Program (UHELP), which provides limited direct civil legal services at the law school to socially and economically needy older persons as well as their caregivers.
