Summary:
HRCP Rule 26(C) – Discovery Plan.  A discovery plan must state the parties’ views and proposals on any issues about disclosure, discovery, or preservation of electronically stored information, including the form or forms in which it should be produced.

The purpose of this presentation to provide Hawaii Litigators key points in developing eDiscovery Plans, including tips in developing defensible processes for data preservation and collections.

We will also demonstrate DIY eDiscovery Tools that can be used to collect, review and produce ESI:

Client email – tips on client self-collecting email from Outlook, Office 365 or GMAIL.
Use a file management system to preserve dates
Reviewing and Producing “native email” using PST Viewer Pro (a $49 program!)
Bates Numbering and Confidential Endorsements (Freeware!)
Understanding ESI Production Formats
