Summary:
The Health Insurance Portability and Accountability Act (HIPAA) regulates the healthcare industry’s use and disclosures of protected health information (PHI). While there are limited situations where attorneys are directly regulated by HIPAA, there are many instances where the requirements and allowed disclosures of HIPAA and other privacy laws will dictate how PHI is disclosed during the practice of criminal and civil law. This webinar will review the various requirements for access to PHI by courts, clients, civil and criminal attorneys, law enforcement and government agencies as well as past legal decisions by courts, including the Hawaii Supreme Court, that limit some uses and disclosures of PHI.
