It is estimated that there are over 200,000 created condominium units, over 8,000 condominium projects, and 1,646 registered condominium associations in Hawaii representing roughly 170,000 units. This presentation will provide essential condominium 2017 legislative update information integral and relevant to the practice of real property law in Hawaii. These updates include new laws on: the fiduciary duties of association boards; rights of association members; board meeting procedures, membership, and records; proxies and voting; retaliation; and the meaning and effect of the repeal of the statute under which any condominium created prior to July 1, 2006, was formed.
Real property attorneys who represent or represented clients involved in developer’s public reports need to be aware of this major legal changeover when the old law is repealed to ensure a smooth transition to current law.
Carole R. Richelieu, State Department of Commerce and Consumer Affairs
CAROLE R. RICHELIEU is an attorney and the senior condominium specialist with the Real Estate Branch/Real Estate Commission of the State Department of Commerce and Consumer Affairs. She is the former and longest serving chief disciplinary of Hawaii’s Office of Disciplinary Counsel and fund administrator for the Lawyers’ Fund for Client Protection.
Prior to her current position, she was the attorney for the Health Branch of the DCCA Insurance Division and hearings officer for the State Departments of Labor and Land and Natural Resources. Since 1989, she has made numerous presentations, as well as written many articles and contributed to numerous manuals.
She currently serves on the Supreme Court’s Board of Examiners and Commission on Professionalism, as well as HSBA’s Transitioning Lawyers Committee and Senior Counsel Division, and has served on numerous national and state professional organizations, committees, and commissions.
DATHAN CHOY is a licensed CPA and a condominium specialist with the Real Estate Branch/Real Estate Commission of the State Department of Commerce and Consumer Affairs.

Prior to his current position, he worked as a budget analyst for the Senate Ways and Means Committee and in public accounting for a national accounting firm in Honolulu.
