Summary: 

This seminar will cover judicial decisions from Hawaii and mainland courts that impact Hawaii’s real estate and land use practitioners.  The focus will be on cases rendered in the past year, as well as cases of interest that are pending before the appellate courts that may be decided in the coming months.  Topics will include inverse condemnation, coastal easements, regulatory takings (federal and Hawaii), Hawaii Revised Statutes Ch. 343 (including Environmental Impact Statements and triggers for Environmental Assessments), and other hot topics.

Speakers:

Gregory W. Kugle, Esq., Damon Key Leong Kupchak Hastert

Greg Kugle concentrates his practice in the area of litigation and appeals. His litigation practice primarily involves the areas of commercial disputes and business litigation, construction disputes, land use and real estate litigation.  He also represents clients in aviation, bankruptcy, employment, personal injury and insurance coverage cases. He has litigated cases in the State of Hawaii District and Circuit Courts, the Hawaii Bankruptcy Court and United States District Court for the District of Hawaii, and has handled appeals before the Hawaii Intermediate Court of Appeals, the Hawaii Supreme Court and the Ninth Circuit Court of Appeals. Greg has been selected to Super Lawyers in the General Litigation practice and has been recognized by Best Lawyers in the areas of Litigation – Construction, Litigation – Land Use and Zoning, Real Estate Law, Construction Law and Land Use and Zoning Law, and was named Best Lawyer’s Lawyer of the Year in Litigation- Land Use and Zoning (2017) and Lawyer of the Year in Land Use and Zoning (2013). 

Mark M. Murakami, Esq., Damon Key Leong Kupchak Hastert

Mark Murakami practices in the firm’s Dispute Resolution, Real Estate, and Construction and Business and Commercial Law practice groups. His focus is on complex commercial disputes, land use negotiation and litigation, environmental, and general civil litigation. He has appeared in all federal and states courts in Hawaii, most of the administrative boards and commissions, and is licensed in the U.S. Supreme Court, Ninth Circuit Court of Appeals and Court of Federal Claims. He is rated “BV” by Martindale-Hubbell, receiving a rating of 4.4/5.0. He is included on the “Best Lawyer” list for Hawaii in the categories of Land Use and Zoning and Eminent Domain and Condemnation Law.
