Summary:
On October 8, 2020, the Hawaii Supreme Court provided eDiscovery Guidelines, recommending that parties resolve ESI disputes without Court Intervention.

On January 16, 2020, the US District Court Hawaii, provided eDiscovery Rule 26 (f) Checklists:
“These are court approved and counsel should consult them at the beginning of every case involving e-discovery.  All counsel are expected to review the Guidelines.”

ABA Model Rule 1.1: An attorney cannot competently represent a client in these proceedings without having a fundamental understanding of the relevant technologies when undertaking electronic discovery.  Failure to do so could result in ethical violations, malpractice claims and judicial sanctions:

Millions in sanctions wouldn’t be proportional in a case worth only $20,000, right? Wrong. In Klipsch Group, Inc. v. ePRO E-Commerce Ltd., Nos. 16-3637-cv, 16-3726-cv (2d Cir. Jan. 25, 2018), the Second Circuit upheld a $2.7 million sanction against ePRO for its repeated and willful discovery misconduct

We will address defensible processes in identifying, preserving and collecting ESI and demonstrate the efficiencies of eDiscovery Review Software

Ashley King,
Relativity Certified Administrator and a Certified Ediscovery Specialist
Ashley King is an ediscovery consultant with extensive experience managing the ediscovery technology operations for Hawaii’s top law firms.  She is a Relativity Certified Administrator and a Certified Ediscovery Specialist, and also teaches the Ediscovery course at Kapiolani Community College.  She specializes in supervising ediscovery projects from collection to production, focusing on database administration and managing document reviews.  She also supports litigation teams with trial preparation and presentation. 



Mark Seo, HON Discovery Group
Mark Seo is the founder of the HON Discovery Group, a Honolulu-based Forensics, eDiscovery and Trial Technologies firm that helps law firms, government and corporations effectively manage discovery. 
 
Mr. Seo is a graduate of UC Berkeley and holds multiple eDiscovery and Computer Forensic Certifications.  Mark is a frequent speaker on national eDiscovery issues, presenting at many of the premier technology conferences, including (International Legal Technology Conference), Sedona Conference, NY Legal Technology Conference, ABA Annual Conference (s), Hastings School of Law, Boalt Law School and here in Hawaii, the Hawaii State Bar, William S Richardson School of Law and the Hawaii Judicial Conference.
