Summary:

This seminar is designed for attorneys who do not usually practice in this subject matter area. It will provide a background in current bankruptcy law and procedure, covering the basics of bankruptcy law and practice of Chapter 7 and Chapter 13, the first meeting of creditors, and 11 U.S.C. § 341, the professional responsibility of the attorneys in Chapter 7, and corporation in Chapter 7 and Chapter 11.  Ethical considerations will also be discussed.

The Honorable Robert J. Faris,
 Chief Judge of the United States Bankruptcy Court for the District of Hawaii; Judge of the United States Bankruptcy Appellate Panel of the Ninth Circuit
Robert J. Faris is the Chief Judge of the United States Bankruptcy Court for the District of Hawaii. He is also a judge of the United States Bankruptcy Appellate Panel of the Ninth Circuit. He received a B.A. from Reed College in 1980 and was elected to Phi Beta Kappa.. He received his J.D. from the Boalt Hall School of Law, University of California, Berkeley, in 1983. He served as an associate editor of the California Law Review in 1982-83, published “Insurance Corporation of Ireland v. Compagnie des Bauxites de Guinee: Justifying Establishment of Jurisdiction as a Discovery Sanction,” 70 Calif. L. Rev. 1446 (1982), and was elected to the Order of the Coif. From 1983 until 2002, he practiced with a Honolulu law firm, emphasizing bankruptcy, insolvency, and commercial litigation. He became a bankruptcy judge in February 2002 and joined the Bankruptcy Appellate Panel in August 2015. He is a member of the American Bankruptcy Institute, the National Conference of Bankruptcy Judges, and the American College of Bankruptcy.




Jerrold K. Guben, 
Partner at O’Connor Playdon Guben & Inouye LLP
Jerrold K. Guben is a partner at O’Connor Playdon Guben & Inouye LLP. He concentrates his practice in commercial and corporate litigation, bankruptcy and corporate reorganizations. He received his B.S. degree from the University of Southern California, his A.M. degree from the University of Michigan and his LL.B. degree from Harvard Law School. Mr. Guben has served as a lecturer in law and as a research associate at Yale Law School, and was on the faculty of the William S. Richardson School of Law, University of Hawaii. He is a member of the Hawaii State Bar Association and the State Bar of California.




Rick Abelmann, 
Bankruptcy Attorney in Hawaii and New York
Rick Abelmann is a bankruptcy attorney admitted to practice in Hawaii and New York. He graduated in economics from Brigham Young University before obtaining his law degree at Washington University in St. Louis. Rick previously practiced corporate and securities law in Hong Kong with Clifford Chance and worked on the trading floor for the institutional equities division of Morgan Stanley. Rick moved to Hawaii in 2009 and has been practicing consumer bankruptcy since then, now as a Member of Abelmann Peterson LLLC.

Aside from his law practice, Rick spends time with his wife and three children. He also enjoys surfing whenever he can find swell. Rick is a member of the Hawaii State Bar Association, the Hawaii Filipino Lawyers Association, the New York State Bar Association, and an active member of the National Association of Consumer Bankruptcy Attorneys (NACBA). He spends several weeks a year involved as a Director of the nonprofit organization he founded called Help One Future, which provides donated school supplies and books primarily to elementary level students in remote areas in the Philippines. He also volunteers his time with Volunteer Legal Services Hawai’i helping low-income people and families have access to justice. He served as a Lawyer Delegate to the USDC District Conference for 2013-2016.



Elizabeth Kane, Panel Chapter 7 Bankruptcy Trustee in the District of Hawaii
Elizabeth Kane serves as a panel Chapter 7 bankruptcy trustee in the District of Hawaii, a position she has held since 2011. She is a graduate of the UC Berkeley School of Law and has been practicing bankruptcy law in Hawaii since 1988. She is a member of the American Bankruptcy Institute, the American Bar Association, the Hawaii Bankruptcy Bar Association, and the National Association of Bankruptcy Trustees. She is a frequent speaker on topics related to bankruptcy law.




Lars Peterson, 
U.S. and German attorney
Lars Peterson is a U.S. and German attorney. He has been admitted to practice in all courts in the State of Hawai’i and the State of Georgia, the U.S. District Court for the District of Hawai’i, the U.S. Court of Appeals for the Ninth Circuit, and is eligible to practice in Germany and European Union member states. He attended WSRSL for his first year of law school and subsequently transferred to and graduated from University of Cincinnati College of Law in 2005. Besides working in the area of consumer bankruptcy law, he has also worked as a criminal defense attorney and in insurance coverage matters. He is an inactive member of the State Bar of Georgia since 2005 and of the State Bar of Hawaii since 2006. He is a member of the HSBA, the Hawaii Bankruptcy Bar Association, the American Bankruptcy Institute, and the National Association of Consumer Bankruptcy Attorneys (NACBA). 



Bradley Tamm, 
Chief Disciplinary Counsel in the Office of Disciplinary Counsel to the Hawaii Supreme Court
Bradley R. Tamm is the Chief Disciplinary Counsel in the Office of Disciplinary Counsel to the Hawaii Supreme Court, and as Administrator to the Lawyers’ Fund for Client Protection. 

Prior to appointment, he served as outside general Counsel to the Disciplinary Board (2012 to 2018); and prior to that as an attorney member of the Disciplinary Board (2006 to 2012).  

Mr. Tamm's private practice (from 1992 to 2018) was primarily limited to federal bankruptcy law (consumer debtor and trustee representation).  A 1991 graduate of Thomas Jefferson School of Law, he is also admitted in California (inactive); and a member of the bars of the U.S. Supreme Court; 9th Circuit Court of Appeals; and U.S. District Courts for Hawaii, Northern, Eastern and Southern Districts of California, as well as the U.S. Court of International Trade and U.S. Tax Court
.
